Property Law Courses

Students of this course will explore various websites designed to supplement and support the concepts that focus on the substantive areas of property and contract law. The class will address the various classifications of property -- real versus personal and tangible versus intangible. Students will also discuss the various ways that property may be owned, and how ownership may be encumbered or transferred. Students will also discuss the laws relating to property ownership and how contracts are frequently encountered in the business setting. The overall development of business entities, students will learn, has been a natural outgrowth of the Constitutional right to contract.

The laws of contracts give legal status to both the individual and businesses -- allowing them both to enjoy all legal protections relating to the rights and obligations of the parties entering contracts.

In this course, students will gain a better understanding of property ownership as a generic term rather than a legal term. Property rights in the American legal system are protected by U.S. Constitutional law, which is rooted in English common law. In centuries past, kings and queens owned anything they could see from their castles and gave land away to their loyal and subservient subjects.

Modern valid contracts, on the other hand, contain legally binding terms -- even if those terms are verbal. Unfortunately, some contracts, written or oral, are broken and someone and certain parties may be harmed by this breach. Legally, this breach of contract can be fixed through the proper course of action.

This course will help students understand the various classifications of contracts, the elements required to form a proper contract, what constitutes a breach of contract and the legal remedies available to a party harmed by a broken contractual promise.
