Legal Malpractice Courses

This course covers malpractice -- a specialized area of negligence also known as professional negligence. The class will also discuss misrepresentation, nuisance and misuse of legal process.

Malpractice is a suit filed against professionals for not meeting up to the standards of other professionals in their field of business. There are, however, defenses that can be used to protect a defendant from liability.

Three types of misrepresentation are actionable: intentional, negligent and innocent. Two other types of injuries that give rise to special tort actions are the private nuisance and the public nuisance. A public nuisance is using land which injures the public rather than one person. A private nuisance, on the other hand, deals with one person’s property.

Malicious prosecution is a final type of tort that requires filing a complaint. If the accused is found not guilty, they can claim to have suffered damages or abuse of process.
